At Smartshifts Ltd. we are committed to protecting your personal information and being transparent about what we do with it. Smartshifts Ltd. will be considered as the "controllers" of your data. How do we use this information?
Smartshifts Ltd. will use your personal information for shift allocation, job recruitment, placements, notifications of shifts, notifications of available healthcare workers, and for the general fulfilment of temporary work assignments, including data regarding the organisation, shift availability and advertised rates.
When do we share your information with other organisations?
Smartshifts Ltd. will share data with other organisations for the purposes of performing checks for background, immigration status, right to work, criminal and police, education / certifications and memberships of professional bodies. Smartshifts Ltd. will only share data that is required to perform the relevant check.
How long do we retain your information for?
We will only keep your personal data for as long as is necessary for the purposes for which it was collected. In order to determine the appropriate retention period for your personal data, we consider the amount, nature, and sensitivity of your personal data and the likelihood of a suitable job placement.
What rights do you have under data protection laws?
Under the Data Protection Act and GDPR, you have the following rights:
- Access to your personal information. You have the right to request a copy of the personal information we hold about you
- Updates and corrections to your personal information. You can request an update to your personal information to ensure it is up to date and accurate
- Removal of your personal information. You can ask us to delete personal information we hold about you if you believe we no longer need it or you want to withdraw your consent for us to use it for it's originally intended purpose. You can also ask us to delete your information if you believe there are valid legal objections to the use of your information
Additionally, you can:
- Object to the way we use your information. You have the right at any time to require us to stop using your personal information for direct marketing purposes. Also, where we use your personal information to perform tasks carried out in the public interest or pursuant to the legitimate interests of us or a third party then, if you ask us to, we will stop using that personal information unless there are overriding legitimate grounds to continue
- Restrict how we use your information. In some cases, you may ask us to restrict how we use your personal information. This right might apply, for example, where we are checking the accuracy of personal information about you that we hold or assessing the validity of any objection you have made to our use of your information. The right might also apply where this is no longer a basis for using your personal information but you don't want us to delete the data. Where this right is exercised, we may only use the relevant personal information with your consent, for legal claims or where there are other public interest grounds to do so
- Ask for your information to be transferred to another party. If we process personal information that you provide to us on the basis of consent or because it is necessary for the performance of a contract to which you are party, and in either case that processing is carried out by automated means, then you have the right to have that personal information transmitted to you in a machine readable format. Where technically feasible, you also have the right to have that personal information transmitted directly to another controller
- Withdraw your consent for smartshifts to use your information. Where we use your personal information with your consent you may withdraw that consent at any time and we will stop using your personal information for the purpose(s) for which consent was given
